Class A Misdemeanor

  • No court supervision
  • Mandatory conviction
  • Probation or conditional discharge
  • Revocation of driving privileges
  • DUI Alcohol or Drug counseling based upon DUI evaluation
  • Mandatory five days jail or 240 hours of community service
  • $1,000 DUI Technology Fee
  • $50 Roadside Memorial Fund Fee (730 ILCS 5/5-9-1.17)
  • Fines up to $2,500
  • BAC > .16 or greater
    • Mandatory 100 hours community service
    • Mandatory minimum fine of $500

With a Passenger Under 16

  • Six months in jail or 25 days of community service in a program benefiting children
  • Subject to a mandatory minimum $1,000 fine
  • Up to $2,500 maximum fine

Bodily Harm Caused to Passenger Under 16

  • Class 4 Felony
  • Minimum $2,500 fine
  • Maximum $25,000 fine plus 25 days community service in a program benefiting children
  • Mandatory minimum of ten days jail or 480 hours of community service

If Great Bodily Harm, Disability, or Disfigurement to Any Person

  • Class 4 Felony
  • 1-12 years imprisonment or probation up to 30 months
  • Mandatory minimum of ten days jail or 480 hours community service
  • Minimum $2,500 fine

Class A Misdemeanor

Great Bodily Harm, Disability, or Disfigurement to Any Person

  • Class 4 Felony
  • 1-12 years imprisonment or probation up to 30 months

Class 2 Felony

  • 3-7 years imprisonment
  • Probation up to 48 months
